Previously, we had discussed that a privately owned road would need a maintenance agreement between owners/users for FHA. A realtor asked me today if the borrower would be allowed to sign a waiver; she believes she did another FHA loan where they were allowed to sign a waiver acknowledging that there was no maintenance agreement. Do you believe this is an option?
